(1) When requesting extradition in accordance with section 7, the requesting state shall disclose the following details:-

(a) Information regarding the real identity of the absconding accused or the offender, including identity, nationality, national identity card number, and as far as possible the current place of residence,

( b) The place, date and details of the offence, (c) the applicable legal provisions of the requesting state regarding the offense and what may or may not have happened if the offense has been established or the offense has been established. Maximum punishment.

(2) When making a request for extradition in accordance with section 7, the requesting state shall attach the following documents: –

(a) With the offense Relevant documentary evidence,

(b) a warrant issued by the competent authority for the arrest of such accused or offender,

(c) a copy of the judgment passed by a competent court or other competent authority in relation to the extradition of the offender,

(d) except for the offense mentioned at the time of making the request for extradition Undertaking not to prosecute for other offences,

(e) Undertaking not to prosecute for offenses punishable by less than the punishment for the offense mentioned at the time of extradition request,

(f) an undertaking not to extradite the extradited fugitive accused or offender to any other State,

( g) Commitment to take the prior consent of the Government of Nepal in case of non-delivery as per Clause (f).
